Lawyers for former Finance Minister Ken Ofori-Atta claim that a United States immigration court has approved his application for adjustment of status, paving the way for him to obtain lawful permanent residency in the country.
The claim was contained in a press release issued by his legal team on June 16, 2026. However, the reported court decision has not been independently verified.
Lawyers Announce Green Card Approval
According to the statement, the US Immigration Court granted Mr Ofori-Atta’s I-485 petition, which allows eligible applicants already in the United States to apply for permanent resident status without leaving the country.
The lawyers said the court considered evidence relating to actions taken by Ghana’s Office of the Special Prosecutor (OSP), including its earlier decision to declare Mr Ofori-Atta a fugitive from justice while he was reportedly receiving medical treatment in the United States.

Claims About Ghana Proceedings
The legal team further claimed that the court questioned the credibility of the criminal case against the former finance minister.
“The court heard evidence relating to actions taken by Ghana’s Office of the Special Prosecutor, including the OSP’s earlier decision to declare Mr Ofori-Atta a fugitive from justice at a time when he was reportedly undergoing medical treatment in the United States and while his lawyers remained in communication with investigators in Ghana,” the statement said.
It added that the court found the criminal charges in Ghana “not credible.”
Immigration Ruling Separate from Ghana Case
Despite the claims, the lawyers acknowledged that the ruling was made within the context of US immigration proceedings and did not determine any criminal liability in Ghana.
“The court’s ruling was made within the context of a United States immigration proceedings. The court’s decision was focused on whether Mr Ofori-Atta met the legal requirements for adjustment of status,” the statement said.
Any criminal charges against Mr Ofori-Atta remain subject to the jurisdiction of Ghanaian courts and ongoing legal processes in the country.

Mr. Ofori-Atta, who served as Finance Minister under former President Nana Addo Dankwa Akufo-Addo, is currently facing multiple legal challenges in Ghana relating to decisions taken during his tenure in office.
While the legal team insists the US court has approved his Green Card application, independent verification of the ruling and its broader legal implications remains ongoing.
The Office of the Special Prosecutor has yet to publicly respond to the claims contained in the statement.
