Accra, Ghana, A legal analyst has cautioned Akosua Serwaa Fosuh against pursuing her appeal in the ongoing court battle over the marital status and widowhood rights in the estate of the late highlife legend Daddy Lumba, warning that it could lead to further embarrassment and legal setbacks. The advice comes amid fresh debate over the appeal Akosua Serwaa has filed against a High Court ruling that recognised both her and Priscilla Ofori, popularly known as Odo Broni, as valid wives of the late musician, effectively dismissing her claim to be the only lawful spouse.
Kwesi Fokuor-Benyin, a private legal practitioner, has raised serious concerns about the appeal filed on behalf of Akosua Serwaa Fosu, warning that the move could expose her to another damaging legal setback. In an analysis of the ongoing legal dispute surrounding the estate of the late highlife legend Daddy Lumba, legal analyst Kwesi Fokuor-Benyin described the appeal as ill-advised and procedurally flawed, suggesting that it stands little chance of success at the appellate level.
Serwaa’s appeal challenges the Kumasi High Court’s November 28, 2025, judgment, which found that she had not sufficiently proved a valid civil marriage with Daddy Lumba under Ghanaian law. Instead, the court held that the evidence, particularly the marriage certificate she presented from Germany, was not properly admitted and that her union could at best be recognised as a customary marriage.
According to him, beyond the substantive weaknesses already evident in the High Court judgment being challenged, the notice of appeal itself suffers from fundamental defects. He noted that the document appears to have been hastily prepared, pointing to typographical errors, poor drafting, and, more significantly, inadequately framed grounds of appeal.
The commentator concluded by urging those close to Akosua Serwaa to reconsider the appeal, reduce public commentary on the case, focus on property distribution matters, and adopt a more strategic and measured legal approach going forward.
